Thank you for your interest in taking part in the “Volkswagen Design Contest – ID.3 2050” run by Volkswagen AG, Berliner Ring 2, 38440 Wolfsburg, Germany, info@volkswagen-newsroom.com, entered in the commercial register of the Braunschweig District Court under commercial register number 100484 (“Volkswagen AG”). The following information regards the processing of your personal data by Volkswagen AG in the context of your participation.
B. Processing of your personal data
To mark World Design Day on 27 April 2020, we are asking you to post your 3D model of a Volkswagen ID.3 for 2050 on your personal Instagram account with the hashtag #VolkswagenDesign2050. The Volkswagen Design Team, led by Klaus Bischoff, Executive Director of Volkswagen Design, will select the best three designs within a three-week judging period, and the winners will then be invited to Wolfsburg. Volkswagen AG will create a ¼-scale model for the overall winner of the contest, based on the 3D data.
To enter the contest, please publish images or video of your 3D model on Instagram with the hashtag #VolkswagenDesign2050. In the course of selecting winners, the Volkswagen Design Team will use your personal data published on Instagram. Processing of the personal data logged there is required to run the “Volkswagen Design Contest – ID.3 2050”. Your data will not be stored. Only the personal data of the three winners will be further processed in order that they can be contacted. The data will be processed pursuant to point b) of Article 6(1) GDPR. Volkswagen AG has no influence on data collection and processing by Instagram following publication of models on the participant’s personal account. Details of the purpose and extent of data collection and further processing and use of data by Instagram, including your rights in this regard and settings to help protect your privacy, can be found in the Instagram Data Policy.
To enable us to invite the designers of the three best 3D models to Wolfsburg, Volkswagen AG will process their contact details (first name, surname, phone number and email address). These data are processed to allow winners to be invited to Wolfsburg, and as such are processed on the basis of point b) of Article 6(1) GDPR. The Volkswagen Design Team will contact winners electronically following the selection process, and send a declaration of consent via email. By means of this declaration of consent, winners agree to have their name and images/videos of the 3D models published as part of the press and public relations work carried out by Volkswagen AG in relation to the “Volkswagen Design Contest – ID.3 2050”. Personal data will be published via the company’s website and/or web pages, including but not limited to social media used by the company (Facebook, Twitter, Instagram, Pinterest, YouTube and LinkedIn), and for third parties (media representatives, agency staff, bloggers, influencers). The winners’ personal data will be processed pursuant to point b) of Article 6(1) GDPR based on the consent to be granted separately. Volkswagen also transfers the winners’ details worldwide to countries with a lower level of data protection than the European Union has. Personal data collected from the winners will only be stored for as long as is necessary for the aforementioned purposes, but not beyond withdrawal of the consent to be granted separately, unless a longer retention period is required or permitted by law. The data shall be erased again following withdrawal of consent or when it is no longer required for the aforementioned purposes. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal. Exceptions to this erasure generally arise due to permanent retention in the Group archive of documents which relate to the company and are of historical significance (e.g. press information), and due to legal provisions. Your data may also, in principle, be stored permanently for archive purposes.
C. Your rights
You may assert the following rights against Volkswagen AG at any time free of charge. Further information regarding protection of your rights can be found under Section C.
Right to information: You have the right to receive information (Article 15 GDPR) from us regarding the processing of your personal data.
Right to rectification: You have the right to request that we rectify (Article 16 GDPR) any incorrect or incomplete personal data relating to you.
Right to erasure: You have the right to request the erasure of your data if the conditions mentioned in Article 17 GDPR have been met. Accordingly, you may, for instance, requested erasure of your data if it is no longer necessary for the purposes for which it was collected. In addition, you may request erasure if we process your data on the basis of your consent and you revoke this consent.
Right to restriction of processing: You have the right to request the processing of your data to be restricted if the requirements of Article 18 GDPR have been met. This is the case if, for instance, you dispute the correctness of your data. You may then request restriction of processing for the period during which the correctness of your data is checked
